Official Sweepstakes Rules

  1. Organizer. The 2012 Update Your Space Sweepstakes (the "Sweepstakes") is organized by DwellStudio ("Organizer").
  2. Binding Agreement. To enter the Sweepstakes, each entrant ("you" or "your") must agree to the Official Sweepstakes Rules ("Rules"). You agree that by submitting your entry in the Sweepstakes, you are agreeing to the Rules, which form a binding legal agreement between you and Organizer with respect to the Sweepstakes. To enter this Sweepstakes, you must have access to the Internet.
  3. Eligibility: The Sweepstakes is open to legal residents of the fifty (50) contiguous United States and the District of Columbia who are at least eighteen (18) years of age. Employees of Organizer and their immediate families (spouse, parent, sibling, child, and spouse of any of the foregoing) and those living in their immediate households, whether or not related, are not eligible to enter the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations, and is void where prohibited by law. To enter this Sweepstakes, you must have access to the Internet, and a valid e-mail address.
  4. Sweepstakes Entry Period: The Sweepstakes entry period begins at 12:00 AM (EST) August 23,, 2012 and is expected to end on September 18, 2012 at 11:59 PM (EST) (the "Entry Period"). However, the Organizer reserves the right to end the Entry Period early in its sole discretion.
  5. How to Enter: No purchase is necessary to enter, and a purchase does not increase your chances of winning. During the Entry Period, you may enter the Sweepstakes either online or at one of our retail stores. To enter online, visit our website at http://www.dwellstudio.com/update-your-space-sweepstakes, or our Facebook page at http://www.facebook.com/dwellstudio. You must be a Facebook user to enter via Facebook. To enter in stores, visit a participating DwellStudio retail store during normal business hours, and provide a valid email address to a DwellStudio sales associate. Organizer reserves the right to disqualify any entry for any reason, in its sole and absolute discretion. Odds of winning depend upon the number of entries received.
  6. Publicity. As a condition of entry into the Sweepstakes, except where prohibited by law, each entrant grants to Organizer and its affiliates, legal representatives, assigns and licensees, all right, title and interest in and to use of the entrant's name, city, state, and biographical material (collectively, "Licensed Rights") for publicity, broadcast, and/or display in any media now or hereafter known throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission or approval of the winner. Where necessary, the winner will be required to execute and return an Affidavit of Eligibility/Liability and Publicity Release within five (5) business days of attempted notification, or the winner may be disqualified and an alternate winner selected.
  7. Judging and Selection of Winner. The odds of winning depend on the number of Entries received. Within thirty (30) days of the conclusion of the Sweepstakes Entry Period, one (1) winner will be randomly selected by Organizer. Organizer's decisions are final and binding. The Winner will be notified via email to the email address submitted with the Winner's entry within ten (10) business days of selection. Winner must sign and return any required documentation including, without limitation, an affidavit of eligibility, a liability release and a publicity release within ten (10) days after notification in order to accept his/her prize. If a potential winner fails to respond to Sponsor's notification or accept the prize within ten (10) business days for any reason or if a prize or notification is returned as undeliverable, the prize is forfeited and Sponsor may choose to select an alternate winner in a random drawing of all remaining eligible entries received.
  8. Prize. The approximate retail value of the Winner's prize is $5000 (USD) of DwellStudio product of the Winner's choosing. The Organizer reserves the right to substitute the specific prize(s) for products of similar value. There is no cash alternative and prizes must be taken as offered. If the Winner chooses not to accept the prize, an alternate Winner will be chosen. All federal, state, and local taxes on the value of the prize are the sole responsibility of the Winner. The Winner agrees to sign and return to Organizer any tax and release forms that are required or else forfeit the prize and be deemed disqualified.
  9. Collection of Personal Data. By submitting an entry, you agree that Organizer can collect certain personal information from you. If Organizer cannot collect the required data, you may not be eligible to participate in the Sweepstakes.
  10. General Conditions. This Sweepstakes is governed by the laws of the State of New York. All federal, state and local laws and regulations apply. By participating in this Sweepstakes, you agree to be bound by the terms of these Rules and by the Organizer's decisions, which are final and binding on all matters pertaining to the Sweepstakes. Organizer reserves the right, in its sole discretion, to disqualify any entrant found to be (i) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes; (ii) violating the Rules; (iii) violating the terms of service, conditions of use or general rules or guidelines of the any property or service of Organizer; or (iv) acting with the intent to annoy, abuse, threaten or harass any other person. Any false information provided within the context of this Sweepstakes by any entrant concerning identity, postal address, or ownership of rights, and/or noncompliance with the Rules may result in the entrant being deemed disqualified from the Sweepstakes. Organizer further reserves the right to disqualify any entry that it believes, in its sole discretion, infringes or violates the rights of any third party or otherwise does not comply with the Rules. Organizer and its respective officers, directors, trustees, employees, agents, successors and assigns (collectively, the "Released Parties") are not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect or delay in operations or transmission. Released Parties are not responsible for theft or destruction or unauthorized access to or alterations of Sweepstakes materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Released Parties are not responsible for inaccurate transmissions or of failure to display Sweepstakes materials as a result of technical problems or traffic congestion on the Internet or at any website. If for any reason the Sweepstakes cannot run as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Released Parties reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Sweepstakes.
  11. Rules/Winners' List Requests: To obtain a copy of these Official Rules or for notification of the Winner, send a self-addressed stamped envelope to the 2012 Update Your Space Sweepstakes, 155 6th Avenue 7th Floor, New York, NY 10013. Requests for the Winner's identity must be received within three (3) months of the end of the Entry Period.
  12. LIMITATIONS OF LIABILITY; INDEMNIFICATION: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM, RELATING TO OR INCIDENTAL TO (i) ANY ACT, OMISSION, DEFAULT OR BREACH BY YOU OF THE RULES OF ANY WARRANTY BY YOU SET FORTH HEREIN; AND (ii) YOUR PARTICIPATION IN THE SWEEPSTAKES AND/OR YOUR USE OR ACCEPTANCE OF ANY PRIZE WON.
  13. Severability. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
  14. Entire Agreement. This binding agreement is the entire understanding between you and Organizer concerning the Sweepstakes and supersedes and replaces any previous understandings between the parties concerning the Sweepstakes.
